In some areas of automobile sales and automobile parts production and operation activities, there are phenomena of producing, selling, and using counterfeit and inferior automobile parts, false advertising, commercial bribery, and consumer fraud. These behaviors disrupt the order of the automobile market and infringe upon the legitimate rights and interests of consumers. In order to further strengthen the supervision of automobile sales behavior and automobile parts quality, maintain the order of the automobile market, protect the legitimate rights and interests of consumers, and promote the stable and rapid development of the automobile industry and economy, the following issues are hereby notified:
1、 Fully recognize the significance of strengthening automobile sales behavior and automobile parts quality supervision, and further enhance the sense of responsibility and mission
The automobile industry is an important pillar industry of the national economy, playing a crucial role in the development of the national economy and society. To cope with the impact of the international financial crisis and implement the overall requirements of maintaining growth, expanding domestic demand, and adjusting structure, the country has formulated a plan for the adjustment and revitalization of the automobile industry, as well as a series of policies and measures to stabilize automobile consumption and accelerate structural adjustment, such as "going to the countryside for automobiles" and "exchanging old for new automobiles", which have played an important positive role in promoting the sustained, healthy, stable development of the automobile industry and the steady and rapid development of the economy. All levels of industrial and commercial administration, transportation, and quality and technical supervision departments should fully recognize the importance of strengthening the supervision of automobile sales behavior and automobile parts quality supervision in ensuring the specific implementation of national automobile industry adjustment and revitalization policies and measures, guaranteeing road transportation, and safeguarding the legitimate rights and interests of consumers. They should deeply implement the scientific outlook on development, conscientiously implement the spirit of the 17th National Congress of the Communist Party of China, the Third and Fourth Plenary Sessions of the 17th Central Committee, and the Central Economic Work Conference, further enhance their sense of responsibility, mission, overall awareness, and service consciousness, fully play their functional roles, effectively fulfill their legal responsibilities, actively maintain the order of the automobile market, and promote the healthy development of the automobile industry.
2、 Further strengthen the supervision of automobile sales behavior, standardize automobile market transactions and competitive behavior
The administrative departments for industry and commerce in various regions should increase their daily inspection efforts, strengthen supervision and inspection of automobile sales behavior, severely crack down on unfair competition, false advertising and other behaviors that infringe on the legitimate rights and interests of consumers in accordance with the law, and effectively regulate automobile market trading behavior. We should carefully sort out and investigate the clues of cases suspected of unfair competition found in daily inspections and appeals, and investigate and punish the unfair competition behavior of automobile brand dealerships and automobile centralized trading markets that falsely represent and advertise in various ways to mislead and defraud consumers in accordance with the law. In conjunction with the special work on combating commercial bribery, it is necessary to strictly investigate and punish the commercial bribery behavior of automobile brand distribution service stores that use the convenience of handling automobile mortgage loans, automobile insurance and other services for consumers to collect so-called "rebates" and "benefits" from financial service companies, guarantee companies, and insurance companies. We need to strengthen the monitoring and inspection of automobile related advertisements, and promptly investigate and punish all types of advertising violations in accordance with the law. We need to further standardize automobile sales contracts, actively promote exemplary texts of automobile sales contracts, and handle "overbearing clauses" in accordance with the law. We need to strengthen administrative guidance, comprehensively use measures such as administrative warnings and suggestions, and stop operators from bundling goods or attaching other unreasonable conditions against the will of buyers.
The administrative departments for industry and commerce, transportation, and quality and technical supervision in various regions should, in conjunction with relevant industry organizations, strengthen publicity and education on automobile production and sales, automobile parts production and operation, and maintenance operators, urge automobile production enterprises to strengthen product quality management, strictly implement the "Regulations on the Management of Defective Automobile Product Recalls", and publish technical information on new vehicle model maintenance; Guide automobile brand distribution service stores to publicize the automobile parts supply system, guide operators to clearly state information such as automobile parts manufacturers, parts prices, service prices, etc., improve quality management systems and sales service standards related to product "three guarantees", advertising, sales contracts, mortgage loans, insurance, etc., promote industry self-discipline, and standardize the business behavior of automobile sales and maintenance industry.
